Terms and Conditions

Agreement & Contract

When a booking is made with Ngotea Distinctive Safaris (NDS), either directly or through an agent, a contractual agreement is established between the client and Ngotea Distinctive Safaris (NDS) Tanzania Limited.

Reservations and Payment

To facilitate efficient planning, please provide your tour number (or custom itinerary), intended travel dates, number of travelers, rooming preferences, and flight details, if available.

Upon confirmation, submit full passport names, nationality, passport number, and date of birth for all travelers.

A 40% deposit is required to confirm the booking. The balance must be paid at least 60 days before tour commencement. Deposits must be received within 14 days of booking. Failure to remit the deposit on time will result in the booking being downgraded or cancelled.

Bookings within 40 days of the tour start will be accepted subject to availability, full payment, and documentation.

Payment Methods

All prices are quoted in US Dollars. Payment can be made via wire transfer or cash. Credit card, foreign cheque, or traveler’s cheque payments may be accepted subject to applicable bank and service fees. Ngotea Distinctive Safaris is not liable for wire transfer fees.

Cancellation & Refund Policy

All cancellations must be communicated in writing and confirmed by phone.

Cancellation charges:

  • 61+ days before tour: 30% of total cost
  • 31–60 days before tour: 50% of total cost
  • 0–30 days before tour: 100% of total cost

Special cancellation rules:

  • Bookings made via NDS or agents: 40% standard fee + up to 80% penalty if cancelled 60–31 days prior; 100% thereafter.
  • Private campsite bookings: incur $60 per person/day cancellation charge.

Amendments are subject to availability. No refunds for unused services, no-shows, or early departures.

Transportation

Only safari-ready 4×4 vehicles are used. NDS may subcontract services. Clients may not drive these vehicles. Travel (land/sea/air) is subject to the carrier’s terms and international conventions. NDS is not liable for disruptions beyond its control.

Accommodation

Prices are based on twin sharing unless stated. Single supplements may apply. Equivalent accommodations may be substituted without refund or liability. All published prices are subject to change due to external factors.

Inclusions

Ground arrangement prices include:

  • Accommodation, meals, park fees, transfers, excursions, and safari vehicle with guide, as specified in the itinerary.

Exclusions

Excludes: airport taxes, visas, vaccinations, insurance, tips, laundry, drinks, and personal expenses.

NDS reserves the right to apply surcharges due to unforeseen costs. Non-payment within 14 days may be treated as cancellation.

Client Information

NDS acts as a booking agent and is not responsible for the actions or omissions of third-party service providers. Liability is governed by the laws of the operating country.

NDS may subcontract services and is not responsible for baggage loss or damage. It may cancel, amend, or refuse service at its discretion.

Health & Safety

Clients are responsible for obtaining all required vaccinations and malaria prophylaxis. Participation in safaris carries inherent risks; NDS is not liable for illness, injury, or death unless caused by gross negligence.

Insurance

Comprehensive travel and medical insurance is mandatory. It should cover:

  • Cancellations, evacuations, medical/repatriation expenses, baggage, and personal losses.

Clients without insurance may not access emergency services. AMREF Flying Doctor cover is available upon request and included in some itineraries.

Itinerary Amendments

Itinerary changes may occur due to weather, wildlife movements, or logistics. NDS reserves the right to substitute accommodations or alter routes without liability.

Force Majeure

NDS is not liable for disruptions caused by force majeure events (e.g., war, natural disasters, government restrictions).

NDS reserves the right to deny or remove travelers who compromise the safety, enjoyment, or operation of the tour.

Travel Documents

Clients are solely responsible for valid documentation, including visas and health certificates. NDS is not liable for delays due to inadequate documentation.

Liability

NDS acts only as an agent and is not liable for illness, injury, loss, or delays caused by third parties or force majeure.

Photography

NDS may use photographs taken during trips for promotional purposes. Client-provided images may also be used with permission.

Complaints

Complaints must be reported immediately to a tour representative and followed up in writing within 28 days of tour completion. Delayed complaints will not be considered.

Wildlife and Parks

While rare, wildlife encounters carry risk. Camps and lodges may be unfenced. Follow safety guidelines at all times. Animal sightings are not guaranteed.

Special Requests

Special requests (e.g., dietary needs, mobility concerns) must be communicated at the time of booking. While efforts are made to accommodate them, they are not guaranteed.

Legal Jurisdiction

These terms and any contract with NDS are governed by Tanzanian law. Legal proceedings must be brought in Tanzanian courts.
